By accessing or using the Sparta platform ("Service"), operated by Scalability Data, LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, you must discontinue use immediately. Use of this Service is void where prohibited.
SPARTA IS NOT A MEDICAL SERVICE. EXERCISE INVOLVES INHERENT RISK OF INJURY, INCLUDING SERIOUS INJURY OR DEATH.
Before beginning any exercise program, you must consult a licensed physician or qualified healthcare provider, particularly if you have or suspect any medical condition, injury, cardiovascular disease, diabetes, hypertension, pregnancy, or any other health concern.
Nothing on this platform constitutes medical advice, diagnosis, or treatment. Workout programs, exercise instructions, and coaching guidance provided through Sparta are for informational and fitness purposes only. You assume all risk associated with your participation in any exercise activity.
If you experience chest pain, shortness of breath, dizziness, unusual pain, or any other concerning symptom during exercise, stop immediately and seek emergency medical attention.
Sparta is a software platform that connects independent fitness coaches ("Trainers") with their clients ("Athletes"). The Company provides technology infrastructure — including program delivery, workout logging, messaging, and performance tracking — but does not itself provide personal training, coaching, or fitness instruction.
Trainers using Sparta are independent professionals. The Company makes no representations regarding their qualifications, certifications, or the quality, safety, or appropriateness of any program they design. Your relationship is with your Trainer, not the Company.
By using Sparta, you expressly acknowledge and agree that:
Access to Sparta requires an invitation from a registered Trainer. You are responsible for maintaining the confidentiality of your account credentials. You may not share access or allow others to use your account. You must notify us immediately of any unauthorized use at support@scalabilitydata.com.
Sparta allows you to voluntarily submit health information to assist your Trainer in program design. This information is encrypted at rest and accessible only to you and your designated Trainer. You represent that any health information you provide is accurate to the best of your knowledge. This data is not shared with third parties except as described in our Privacy Policy or as required by law.
You agree not to:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCALABILITY DATA, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR DATA LOSS, ARISING FROM YOUR USE OF THE SERVICE OR PARTICIPATION IN ANY EXERCISE ACTIVITY.
Our total liability to you for any claim shall not exceed the greater of the amount you paid to us in the twelve months preceding the claim or one hundred dollars ($100.00).
All platform software, design, and branding is the exclusive property of Scalability Data, LLC. Workout programs created by Trainers remain the intellectual property of those Trainers. Your personal workout logs and health data remain yours.
We may suspend or terminate your account at any time for violation of these Terms or at the direction of your Trainer. You may request account deletion by contacting support@scalabilitydata.com.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute shall be resolved by binding arbitration in Texas, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive the right to participate in any class action proceeding.
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via the app or email.
